Of course they shouldn't; but it's hardly like MS alone is doing this. This has been the norm with any technology that has any kind of storage for years. Although 40GB of space for the OS and firmware seems VERY excessive

Sometimes they will list devices as "32GB (28GB User Available)" for example. But I think it's the whole "Up to" argument, because it CAN hold that amount, they can advertise it as that, even if it isn't usable.
I think they should make it clear though that you won't get the full amount to use to be honest

That kind of thing I don't mind too much, I appreciate that a formatted will be of lower capacity than the advertised capacity. However like Dec says, 40gb less is ridiculous. I can't see any way they can justify that.
